At PCS, we leverage technology to provide access to the Marisela business-to-business inventory management and medical device billing platform designed to streamline the billing process. We are committed to protecting your privacy and ensuring that your Personal Information is handled in a safe and responsible manner. This Privacy Policy explains how we collect, use, disclose, process, and protect your Personal Information when you use our website, //PCSTech.ai/Marisela, our applications, and access our services (collectively, the “Service”). 

We may modify this Privacy Policy at any time. We will notify you of material changes by conspicuously posting changes along with an alert on the Service, sending you an email, or otherwise notifying you by similar and appropriate methods. All changes will be effective immediately upon posting to the Service.

What is Personal Information?

For the purposes of this Privacy Policy “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with you. Personal Information does not include information that is available in public records or has been deidentified, aggregated, or both to the extent that it is no longer identifiable.

We collect the following categories of Personal Information from users of our Service: 

• Account and Login Credentials: Such as your full name, company name, username, password, email address, phone number, account credentials, authentication information, and other information used to create and manage your account and access the Service. 

• Identifiers and Device Information: Such as your full name, email address, and phone number. We may also collect your IP address, device ID, and other similar identifiers that may be linked to you or your devices.  

• Medical Device Inventory Information: Information uploaded to or processed through the Service relating to medical devices, equipment inventory, product identifiers, serial numbers, maintenance records, utilization data, supply tracking, and related operational information.  

• Billing and Financial Information: Information related to billing, invoicing, reimbursement, payment tracking, and related operational or financial records submitted through or integrated with the Service. Payment card information, if collected, may be processed by third-party payment processors and not stored directly by us except as necessary for transaction records and compliance purposes.  

• Internet Activity: Information related to your interactions with our Service such as page views and IP address.  

• Geolocation Data: We collect some geolocation information, such as your city and state.  

Sensitive Personal Information: We do not collect, store, transfer, share or sell any sensitive Personal Information. 

Sources of Personal Information

Directly from You 

We collect your Personal Information directly from you when you access or use the Service, upload or submit information to the Marisela platform, or otherwise interact with us, such as engaging with support.  

From You Automatically

We may collect certain information about you automatically when you use the Service, such as your IP address, mobile carrier, and other device identifiers that are automatically assigned to your computer or device when you access the Internet. From Third Parties

We and our service providers acting on our behalf may collect Personal Information about you from third parties in several ways, including: 

• We may receive Personal Information about you from third parties that provide services to us through or in connection with the performance or operation of the Service, including our web hosting provider, or our payment processors.  

• We may purchase conference attendee lists from relevant professional organizations to aid our outreach. We never sell this information.   

How We Use Your Information

We use your Personal Information for the following purposes: 

• Operating, maintaining, and improving the Service: We may collect and maintain your Personal Information to operate, maintain, and enhance our Service.We may use artificial intelligence or other automated technologies to analyze, summarize, process, and streamline inventory and billing information submitted through the Service. 

• Communication: To send you information, status updates, notices, and other information related to the Service, such as updates to our policies.  

• Security: To protect the security and integrity of our Service and to prevent fraud or other malicious activity. 

• Legal Compliance: To comply with our legal obligations, enforce our terms of service, and address disputes we may need to provide your information to law enforcement agencies upon submission of a subpoena, or other lawful process. Depending on the nature of the request, we may not be able to advise you that law enforcement agencies are requesting such information.  

Use of De-identified Data

We may use de-identified data, which cannot be linked to you or other individuals using the Service, for the purposes of providing the Service, product development, employee training, research and development, and to gain insights into product improvement and other operational purposes that enhance the Service and your experiences with us.  We take reasonable measures to ensure that our process of de-identifying information about you, and your use of the Service cannot be associated or linked to you.

To Whom We Share Your Information:

We do not sell your Personal Information for any reason. In the performance of providing the Service and our business operations, we may share your information with: 

• Service Providers: We may share your Personal Information with third-party vendors who provide services on our behalf, such as credit card payment processors. When we engage third parties, we limit the way they can access and use your information. 

• Parties to Business Transactions: In the event of an anticipated or actual merger or acquisition, bankruptcy, or other sale of all or a portion of our assets, we may transfer or allow third parties to use information owned or controlled by us, including Personal Information. We reserve the right, in connection with these types of transactions, to transfer, share, assign, or sell your Personal Information and other information we have collected to third parties or to authorize such third parties to use any Personal Information including for due diligence as part of any of the transactions described in this paragraph. Any Personal Information that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity. 

• Government and Law Enforcement: We may share your Personal Information with third parties as required by law or subpoena, or if we reasonably believe such action is necessary to comply with the law and/or the reasonable requests of regulators, law enforcement, or other public authorities, to protect our property, legal rights, safety, or the safety of others, to prevent harm, investigate fraud, or to protect the security or integrity of the Service or any equipment used to make the Service available. 

• Professional Advisors: We use professional advisors, including lawyers and accountants, and may be required to disclose information about you when engaging them for their services and as necessary for audits, financial and other regulatory reviews.  Our sharing of Personal Information with our professional advisors is subject to confidentiality and contractual restrictions on the use and protection of the Personal Information and other data that is shared. 

Cookie and Analytics

We use cookies and collect data on your usage of our website to learn whether the website is operating optimally. We collect data on your interactions with the website to provide audit logs, identify and correct errors and other diagnostic purposes, and to collect statistical traffic data to improve the website.  We do not collect Personal Information through cookies for the purposes of marketing or selling your data to third parties.   

Social Media

Any collection, use, and management of Personal Information when interacting with our social media accounts, including Instagram and LinkedIn, are governed by their respective privacy policies and terms. When using social media, you are required to comply with their privacy policies and terms. We recommend you carefully review their privacy policies and terms, as PCS is not responsible such social media platforms’ use of your Personal Information. 

How Long We Retain Your Information

We retain information about you only for as long as necessary to provide the Service and to comply with applicable law and our contractual obligations. We may retain your Personal Information, posts, and service records for as long as you are a customer to provide you with the Service.  

After it is no longer necessary for us to retain information about you, we will dispose of your information in a secure manner or anonymize the information.  

Aggregated data is retained and used by PCS for analysis, product improvement, and troubleshooting purposes. In some cases, social media content may continue to exist on our social media account pages even after you or we delete it from our Service, and you will need to contact the relevant social media platform directly if you would like to remove this content.  

Your Privacy Choices

Updating Your Personal Information. You may update or correct certain Personal Information you have provided us by editing your account information on the Service or by contacting us. 

Cookies Settings. The Options/Settings section of most internet browsers will tell you how to manage cookies and other technologies that may be uploaded to your device, including how to disable such technologies. You can disable our cookies, or all cookies, through your browser settings, but please note, disabling cookies may impact some of the features of the Service and prevent it from operating as intended. Do-Not-Track. Currently, our systems do not recognize browser “do-not-track” requests. Children’s Privacy

We do not knowingly collect Personal Information from children. The Service not intended for use by children and should only be accessed by individuals who are at least 18 years old. However, please also remember that we cannot guarantee that the internet itself is 100% secure. We are located in the United States of America and all Personal Information we collect or receive on or in connection with the Service will be collected or received in the United States of America. If you access, use, or otherwise interact with the Service or otherwise engage with us from outside the United States, please be aware that the laws applicable to Personal Information collected, stored, used, or otherwise processed in United States of America may not provide the same protections as the laws in other countries or economic regions.

In addition to links to partner websites, the Service may contain links to other third-party websites, or may integrate with or provide access to third-party platforms, applications, software, payment processors, or other third-party services. Rights Applicable to United States Residents

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
